1. Acceptance of Terms

By accessing or using BookEase Pro (the "Service"), operated by Bhavna Infotech ("Company", "we", "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all visitors, users, vendors, and others who access or use the Service, including the website, admin panel, mobile applications (Android and iOS), and API.

2. Description of Service

BookEase Pro is a multi-tenant appointment booking Software-as-a-Service (SaaS) platform that enables:

  • Vendors: To manage their business profile, services, staff, working hours, bookings, and payments through an admin dashboard.
  • Customers: To discover vendors, browse services, book appointments, and make payments via web and mobile applications.
  • Super Administrators: To manage the platform, tenants, subscriptions, and platform-wide settings.

3. Account Registration and Security

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorised use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Obligations

4.1 General Obligations

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Attempt to gain unauthorised access to any portion of the Service.
  • Use automated tools (bots, scrapers) to access the Service without prior written consent.
  • Upload malicious code, viruses, or any harmful content.

4.2 Vendor Obligations

Vendors using BookEase Pro additionally agree to:

  • Provide accurate business information, including valid GST details where applicable.
  • Honour bookings made through the platform.
  • Maintain accurate service descriptions, pricing, and availability.
  • Comply with all applicable laws, including consumer protection regulations and tax laws in India.
  • Handle customer data in accordance with applicable privacy laws.

5. Payment Terms

5.1 Platform Subscriptions

  • Access to certain features requires a paid subscription plan.
  • Subscription fees are charged in Indian Rupees (INR) and are exclusive of applicable GST (18%).
  • Subscriptions are billed monthly or annually as selected. Renewals are automatic unless cancelled.
  • Payment is processed through Razorpay. By subscribing, you agree to Razorpay's terms of service.

5.2 Booking Payments

  • Payments for bookings are transactions between customers and vendors. BookEase Pro facilitates these transactions but is not a party to them.
  • Payment methods include Razorpay (cards, UPI, net banking, wallets), UPI QR codes, and cash.
  • Vendors using platform payment gateways agree to the respective gateway terms and applicable transaction fees.
  • Deposit payments may be required for certain services as configured by the vendor.

6. Intellectual Property

  • The Service, including its original content, features, and functionality, is owned by Bhavna Infotech and is protected by copyright, trademark, and other intellectual property laws of India.
  • The BookEase Pro name, logo, and related marks are trademarks of Bhavna Infotech.
  • Content uploaded by vendors (business descriptions, service details, images) remains the property of the respective vendor, with a licence granted to BookEase Pro to display such content on the platform.
  • Customer reviews and ratings are the property of the respective customers, with a licence to display them on the platform.

7. Limitation of Liability

  • The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
  • We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
  • We are not liable for any disputes between vendors and customers, including disputes regarding service quality, appointment fulfilment, or refunds.
  • In no event shall Bhavna Infotech be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
  • Our total liability for any claim arising out of or relating to the Service shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Bhavna Infotech and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

9. Termination

  • We may suspend or terminate your account at any time, with or without cause, with or without notice.
  • You may terminate your account at any time by contacting support or through your account settings.
  • Upon termination, your right to use the Service will immediately cease. Your data may be retained for a reasonable period as required by law or legitimate business purposes.
  • Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

10. Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of India.
  • Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in India.
  • Before initiating any legal proceedings, the parties agree to attempt resolution through good-faith negotiation for a period of thirty (30) days.

11. Modifications to the Service and Terms

  • We reserve the right to modify or discontinue the Service (or any part thereof) at any time, with or without notice.
  • We may revise these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service.
  • Continued use of the Service after changes constitutes acceptance of the revised Terms.
